The doctor had an obligation to always be right, but the supermarket doesn't have an obligation to provide a safe environment to walk through? BTW, I was at a restaurant the other night and the soap dispenser in the men's room was leaking. You couldn't see anything on the floor, but it was very slippy and the stuff stayed on your shoes for a while, even if you tried to wipe it off. A few people fell down, including my kid. The restaurant was a big chain with deep pockets, but no one sued. |

Autoaccidents happen...get over it. OK, if someone is obviously speeding through traffic and causes something, sure....criminal charges. They kill someone? Absolutely. But a typical fender bender? Well, driving is a privilege, not a right, and you assume a risk every time you go out there, so getting $1.5M for a sore neck from a fender bender on your daily commute, well....tough shit. When I broke my leg skiing at Squaw valley in their terrain park, I went flying off a table top (done it 100 times before) but they put a 'lip' at the end and I wasn't leaning forward enough and I basically went through the air upside down, landed, and broke my leg....bad (tib/fib compound open fracture)....$36K surgery. A few weeks later I got a form/questionnaire from the insurance company about the circumstances of the accident...date/time/weather conditions/etc. Then a few more questions about the staff, who arrived, what equipment was around....I realized they were looking for a reason to sue to the resort. I wrote in big bold letters, 'THIS WAS MY FAULT, I TAKE FULL RESPONSIBILITY FOR THIS ACCIDENT' Could I have made a big deal and tried to sue (despite the big disclaimer on the lift ticket)? Sure.... One less lawsuit, one less lawyer paid big bucks to get money for an insurance company trying to get out of paying for my leg, which is why I PAY THEM. I see that some of you have bought the insurance company propaganda that they have been investing billions of dollars into over the last 30 years to convince you that all evil arises from the lawyers.
What is the vested interest of an insurance company? To make money - to not pay out claims. How have they manipulated you? See above. I'm all for responsibility. This means those that cause injuries must be held responsible, just like those that through their own negligence injure themselves must be held responsible. In addition to making a person whole after they have been hurt by someone else, a lawsuit also serves as a deterrent to bad behavior. Without it, a lot of folks would be a lot worse off. Tort reform is just the insurance companies limiting your right to recover in the event that you are ever seriously injured by the fault of another. You better think about that. As to excessive verdicts causing high premiums for you as a consumer, you really need to look beyond the insurance company driven rhetoric to the facts. On the medical malpractice side, I can promise you that at least in Tennessee, there is no problem with excessive verdicts - as proven through jury verdict research - even though the insurance companies claimed that was what was causing them to raise malpractice premiums. A typical insurance company lie. I've been involved on both sides of the litigation world - representing companies and insurance companies, as well as people - and promise you that I have never seen a verdict that was not justified given the facts of the case. You need to have more faith in what a jury of twelve can do and reason. Wilson "Talk about drugs. I had to hire an attorney to force my Beloved Former Business Partner to do something aside from starve Carrie and I out of our business holdings in Seattle. It took six figures in Attorney fees. He is rumored to have spent twice what we had to defending his position of 'We should just walk away.' An awful lot of time, money and effort wasted to force this (add colorful adjective here) to do what should have been easily able to be done in 2000. It took until June of 2007 to finish it.
