Christian, I never suggested that someone could take a picture of you and use it to sell mobile phones in a magazine ad without your consent.

All I said was that someone is free to photograph or video you on public property and make money by selling the photos and videos to whomever they like OR giving them away freely all over the internet.

I don't think this decision in any way represents an end or even a threat to US rally it may however be the final straw for non-pro-wannabee ralliest being associated with and defending Rally America. This could increase the number of NASA events, NASA licensed competitors, and entries at NASA event. That should really cheese a few people off.

Perhaps I'm missing the point here ?

Rallying doesn't have the big purses like Nascar, F1, etc... because of a lack of grand stands, closed course, big advertising, etc... because it takes place mostly in the forests, government land "borrowed" for a weekend, etc...

Since there's no spectator entry fees, how do they hope to be able to possibly commence litagation against someone with an SLR who walks through the woods with a tripod and takes pictures of rally cars blasting through dirt roads ?

This amateur then gives the pics to the competitors.

I mean... what the fuck ?

Am I mis-understanding something ?
